Battle for Beige: Influencer Aesthetics Go to Court

Sydney Nicole Gifford, queen of the “sad girl beige aesthetic,” is suing fellow content creator Alyssa Sheil for what amounts to aesthetic identity theft. Her 70-page lawsuit basically screams, “You copied my entire vibe—and not in a cute way.”

The Spicy Details

  • 790,000 followers vs. 380,000 followers
  • Allegations: Copycat content down to tattoo placement
  • Damages sought: $30,000-$150,000 (that’s a LOT of neutral-toned filters and AirBnB rentals)

The Legal Issues

Gifford claims Sheil has:

  • Stolen her entire visual brand
  • Mimicked camera angles
  • Replicated product recommendations
  • Basically committed the social media equivalent of identity fraud

Sheil’s defense is, essentially, “Nuh-uh, these are MY sad girl beige posts.”

This case, if it proceeds, will illuminate other industry “luminaries” as to issues surrounding copyright infringement, trade dress infringement, misappropriation of likeness, and how these allegations implicate the Digital Millennium Copyright Act (DMCA).

Why This Matters

This lawsuit could revolutionize how we think about “owning” an aesthetic. Can you copyright “sad girl vibes”? The more pressing issue may be, would you want to?

Stay tuned.

This case should be thrown out as soon as the judge realizes both influencers just copied Restoration Hardware catalogs.
